Terms of Use

1.General

These terms set the rules for using the Brandy app (iOS and Android), the app.brandy.uz website, the @brandy_uz_bot bot, its Mini App and the @brandyuz_official channel (together, “Brandy”). Brandy is provided by DREAMLOGIC TECH LLC (TIN (STIR): 311960493; “we”).

By signing in to or using Brandy, you accept these terms and the Privacy Policy. If you don’t agree, don’t use Brandy. These terms are a public offer under the Law of the Republic of Uzbekistan “On Electronic Commerce”.

Brandy is free to use.

2.What Brandy is and isn’t

Brandy is an online marketplace for buying and selling second-hand clothing, shoes, bags and accessories, branded or not. Sellers post listings; buyers find them and message the seller on Telegram.

• Brandy doesn’t sell, buy or store goods.
• Brandy doesn’t take payments or handle delivery.
• Brandy is not a party to deals between users. The seller and the buyer agree on the price, payment, meeting and delivery between themselves.
• We don’t check every item and don’t guarantee its authenticity, quality or match with the listing. The “Original” label is the seller’s statement.

3.Your account

• You sign in to Brandy with your Telegram account, and on iPhone also with your Apple account. Your name, username and photo in Brandy come from Telegram; with Apple, your name comes from Apple.
• Posting listings needs a Telegram account, because buyers message sellers on Telegram. If you signed in with Apple, you connect Telegram once.
• You are responsible for the security of your Telegram and Apple accounts: anyone who gets into them can also use your Brandy account.
• Creating an account in someone else’s name, or coming back with another account after being blocked, is prohibited.
• Brandy is meant for users aged 16 and over. If you are under 18, you need a parent’s or guardian’s consent to post listings and buy.
• You can browse listings without signing in. Liking, saving, messaging sellers and selling require signing in.

4.Posting listings

By posting a listing, you confirm that:

• the item belongs to you and you have the right to sell it;
• the photos show this very item, and you took them yourself or have the right to use them;
• the description, size, condition and price are true;
• you answered the “Original / Copy” question honestly: “Original” is chosen only for a genuine branded item, and a copy (replica) is openly marked “Copy” (Uzbek «Nusxa»).

Your listing is published in the app, in the Mini App and in the @brandyuz_official channel. In the channel it appears as a collage of its photos, with hashtags and a “View item” button.

When the item is sold, mark it “Sold” or delete the listing. If a listing hasn’t been updated for 30 days, the bot asks “Still not sold?”; with no answer for 7 more days, the listing becomes inactive and is removed from the channel.

We don’t guarantee that a listing is shown for any particular time or to any particular number of people.

5.How listings are ordered

The feed shows listings from your region first, then from the rest of the country. In the “For you” feed:

• first, listings you haven’t seen yet from sellers you follow;
• then other unseen listings, in turns, one from each seller, so that no single seller fills the feed;
• finally, listings you have already seen.

“Picks for you” is chosen from the brands, categories and prices of the listings you liked and saved, and from your sizes. In search, listings can be sorted by newest, lowest price or highest price. Brandy has no paid promotion of listings.

6.Prohibited items and content

The following are prohibited on Brandy:

• stolen, illegal or recalled goods, and goods or services unrelated to clothing, shoes, bags and accessories;
• passing a copy off as the original, or selling with counterfeit brand marks or documents;
• items you don’t have, photos of another item or another person, misleading descriptions or prices;
• nudity and sexual content, violence, hate, discrimination, insults, threats and harassment;
• fraud: taking a prepayment and not handing over the item, fake payment confirmations, luring people elsewhere to deceive them;
• spam, posting the same listing again and again, fake accounts and fake ratings;
• publishing other people’s personal data without their permission;
• attempts to break into Brandy, collecting data with automated tools, or interfering with the service.

Zero tolerance. We have zero tolerance for objectionable content and for abusive or fraudulent users. Such listings are removed without warning, and the account is blocked temporarily or permanently. Brandy refuses listing and profile text that contains profanity or slurs.

7.Reporting

Report a listing or a seller that breaks these rules right in the app: “⋯” on the listing or the seller’s page → “Report” (Uzbek «Shikoyat qilish»), pick a reason and add a comment if you like. The seller never sees who reported them. You can also message us on Telegram (section 17). We review reports within 24 hours, remove content that breaks the rules, block the account where needed and tell you the outcome on Telegram. When several people report the same listing, it is hidden until it has been reviewed.

Blocking. You can block a user with “⋯” → “Block” (Uzbek «Bloklash»): you won’t see their listings and they won’t see yours, and they can’t message you through the bot or rate you. They aren’t told. You can unblock them in Settings → “Blocked” (Uzbek «Bloklanganlar»).

If you hold a copyright or trademark and a listing infringes it, for example by using your photo without permission, contact us the same way: say who you are, which listing it is and which right is infringed. We remove the listing on a well-founded request.

8.For buyers

• See and check the item before you pay. Where possible, meet in a busy public place.
• Never prepay a seller you don’t know. Brandy never asks you for payment or card details.
• The “Original” label is the seller’s word. Check the authenticity of an expensive item yourself.
• Report a suspicious listing or seller to us (section 7).

9.Ratings

Only a buyer who tapped “Write” on a seller’s listing can rate that seller, one rating per listing. A rating must reflect your real experience. Rating for money or another benefit, getting ratings for yourself or deliberately rating competitors down is prohibited; we may remove such ratings. We don’t edit ratings.

10.Rights to content

• The text and photos of your listings remain yours.
• By posting a listing, you give Brandy a free, non-exclusive, worldwide permission to store, process (for example resize or make a collage of) and show them in the Brandy app, website, Mini App and channel, and to show your listing when promoting Brandy. The permission lasts until the listing is deleted.
• Brand names and logos belong to their owners. Brandy is not affiliated with or endorsed by these brands; brand names are used only to describe the items.
• The Brandy name, logo, design and software belong to us. Don’t use them without permission.
• Brandy may show sale listings that sellers published in public Telegram channels. If it is your listing and you don’t want it on Brandy, message us and we will remove it. If you sign in to Brandy with the same username, such listings move to your account.

11.Brandy’s rights

We may:

• remove listings and ratings that break these terms, and restrict or block an account with or without warning;
• change, update or discontinue Brandy features;
• disclose data to the competent authorities when the law requires it (Privacy Policy, section 4).

We are not obliged to check listings in advance, but we may check them at any time. If we close Brandy completely, we will announce it at least 30 days in advance.

12.Liability

• Brandy is provided “as is”. We can’t guarantee that the service works without interruptions or errors.
• We are not liable for deals between users, for the quality, authenticity or delivery of items, or for users’ actions and the harm they cause.
• To the extent the law allows, we are not liable for indirect damage or lost profit related to using Brandy.
• This section doesn’t affect rights that can’t be limited by law, including consumer rights.
• If a third party brings a claim against us because you broke these terms, you are responsible for its consequences.

13.Personal data

How we collect, use and protect your data is described in the Privacy Policy.

14.Deleting and blocking accounts

• You can delete your account at any time in the app: Settings → “Delete account” (Uzbek «Akkauntni oʻchirish», Russian «Удалить аккаунт»). What is deleted is described in section 8 of the Privacy Policy.
• If you break these terms, we may block your account: a blocked account can’t sign in to Brandy or post listings, and its listings are hidden. If you think a block is a mistake, message us and we will review it.

15.Changes to these terms

We may update these terms. We will announce material changes in the app, the bot or the channel at least 30 days before they take effect. Changes required by law or for safety may take effect sooner. If you keep using Brandy after a change, you accept the new terms.

16.Governing law and disputes

These terms are governed by the laws of the Republic of Uzbekistan. We will first try to settle a dispute by negotiation, so please message us. If we can’t agree, the dispute is heard by the courts of the Republic of Uzbekistan as provided by law.

These terms are published in Uzbek, Russian and English. If the texts differ, the Uzbek text prevails.
